1. Products: prices and characteristics
Unless otherwise indicated, the prices of the Products published on the site are expressed in Euros and must be understood as inclusive of VAT. The price guaranteed to the purchaser is that published on the Site at the time the order is sent. The prices of the Products published from time to time by Agricola Borduito S.S.A. on the site cancel and replace the previous ones and are subject to the actual availability of the Products. The images of the products are indicative and not binding and any discrepancy does not affect the essential characteristics of the product. The Customer is responsible for the choice of Products ordered.
2. Orders – tax documentation
Each order of Products constitutes a contractual proposal by the Customer. The fulfillment of the order is equivalent to confirmation and acceptance of the same. The tax documentation relating to the Products ordered will be issued by Agricola Borduito S.S.A. at the time of shipment of the Products to the Customer.
3. Orders – execution
The order will be executed within the terms specified on the Site. Normally deliveries take place within 7 working days for Italy and 15 working days for European destinations for all Products indicated as “available”. In case of non-execution of the order by Agricola Borduito (when this is due to unavailability of the Products ordered by the Customer), Agricola Borduito S.S.A. will inform the Customer as soon as possible of the expected delivery times for the supply of the missing Product.
In case of stock breakage or depletion or unavailability of the ordered Product, Agricola Borduito S.S.A. undertakes to inform the Customer as soon as possible and to specify a timeframe for availability. The Customer will confirm by email their choice, namely to wait for the availability of the Product or request a refund.
4. Orders – acceptance
The conclusion of the contract will occur only upon confirmation of the order by Agricola Borduito S.S.A. The Customer will receive an email notification of receipt containing confirmation of the order with all the constituent elements of the contract (products ordered, prices, delivery dates, shipping costs…). Agricola Borduito S.S.A. reserves the right not to confirm an order for any reason relating in particular to a Product supply problem, or to a problem concerning the order received.
5. Order delivery
The Products are delivered to the address indicated by the Customer. Shipments will take place after receiving confirmation of payments; for payment by credit card, confirmation of the transaction by the circuit.
For our shipments we rely on qualified express courier services. Shipping rates are indicated at the time of order.
Delivery Times
Normally deliveries take place within 7 working days for Italy and 15 working days for European destinations only for products available in stock. The shipping terms indicated on the site, although carefully evaluated, must be understood as non-binding for Agricola Borduito, which may subsequently confirm or modify them, depending on its actual needs. Shipping times are indicated in working days. The shipping time of an order containing items with different delivery times is equal to the longest shipping time of the items in the order. Any delays in deliveries of less than 30 (thirty) days do not give the Customer the right to refuse delivery of the Products, nor to claim compensation or indemnities of any kind. Agricola Borduito S.S.A. has the right to carry out, if it deems appropriate, the delivery of the Products (also relating to the same order) in multiple successive deliveries. Delivery is considered as executed from the moment the Product is delivered to the Customer. The delivery document issued by the carrier, dated and signed by the Customer upon delivery of the Product, will constitute proof regarding transport and release of the goods.
It is important to know that:
Upon delivery, the Customer must verify the content, conformity and condition of the Product(s). Therefore, upon delivery, Agricola Borduito S.S.A. recommends that the Customer verify the condition of the Products delivered before signing the receipt notice, and in particular: that the number of packages being delivered corresponds to what is indicated in the transport document attached to the shipment; that the packaging is intact, not damaged, wet or otherwise altered, and to check the integrity of the contents. Should the Customer notice any anomalies, they must refuse delivery of the products or put their reservations in writing, detailed and dated. Such reservations must be confirmed to the carrier by registered letter with return receipt within 3 (three) working days following delivery of the Products. A copy will be addressed to Agricola Borduito S.S.A. If the courier’s document is signed without adding any “reservation”, the Customer will not be able to raise any objection regarding the external characteristics of what was delivered. Any problems concerning the physical integrity, correspondence or completeness of the Products received must be reported within 3 (three) days of delivery.
Agricola Borduito S.S.A. has the right, at its sole discretion, to deliver the ordered Products by means of a courier chosen by it. Unless otherwise indicated, all deliveries are made at street level. Special delivery conditions and terms must be previously agreed between the Customer and Agricola Borduito S.S.A. and accepted by the latter in writing.
6. Collection in case of customer absence
In case of absence of the recipient during delivery, the carrier will leave a delivery notice at the delivery address indicated by the Customer. The Products must be collected at the address and according to the methods indicated by the carrier. In case of failure to collect within the deadline established by the carrier, the Products will be returned to Agricola Borduito S.S.A., which reserves the right to refund the price of the Products, leaving the shipping costs to be borne by the Customer. In case of error concerning the Product, the Customer undertakes to return said Product or the Products concerned to Agricola Borduito S.S.A. within 7 (seven) days of receipt, provided that they are returned with the packaging closed, in their original state and packaging with the accompanying documents. Once the Product has been received in correct form and manner, Agricola Borduito S.S.A. will resend, at its own expense, the Product initially ordered.
7. Force majeure
Explicitly considered as cases of force majeure, in addition to those normally considered by jurisprudence, are also the following cases: total or partial strikes, internal or external to the company, blockage of means of transport or supply for any reason, governmental or legal restrictions, computer failures, telecommunications blockage including networks and in particular the internet. In case of force majeure, the execution of the order will be suspended, initially, by full right. If after a period of 3 (three) months, the parties note the persistence of the case of force majeure, the order will be automatically canceled, unless otherwise agreed by both parties.
8. Right of withdrawal
EXCLUSION OF THE RIGHT OF WITHDRAWAL
As this involves the sale of food products, which “risk deteriorating or expiring rapidly” being subject to alteration also as a result of inappropriate storage, for hygienic reasons and for the protection of Customers, the right of withdrawal is not applicable. Therefore, the option to return purchased goods is granted only for non-conformity of the order or products (i.e., for product or packaging manifestly damaged upon delivery or incorrect quantities and/or type compared to the order). It will therefore be possible to proceed with this latter option only if at the time of delivery the package is accepted with “Accept with reservation” and including in the description the reason, e.g., “Damaged package”, “Wet package”, etc.
9. Payment
Payment of the consideration is due from the time of order. The Customer undertakes to pay the agreed price for the Product ordered on the Site (price of the Products and transport) as well as to pay, and this directly to the courier or carrier, VAT or other taxes relating to the importation of the Products in the countries where delivery will take place. Accepted forms of payment are: Stripe, credit card, Apple Pay.
10. Complaints
Complaints for non-conformity of the Product(s) delivered with the order must be received in writing directly by Agricola Borduito S.S.A., immediately after receipt of the goods. The Customer must keep the original packaging and the delivery document.
11. Competent court
In case of dispute and in the absence of an amicable agreement reached between the parties, without prejudice to the possible applicability of mandatory provisions of law for the protection of consumers (as defined pursuant to Article 1 letter b) of Legislative Decree May 22, 1999 no. 185), any dispute in any way connected to these General Conditions will be devolved to the exclusive jurisdiction of the Court of Trani. Pursuant to and for the purposes of Articles 1341 and 1342 of the Civil Code, the Customer declares to have carefully read and understood and to specifically accept the following clauses of the General Conditions of Sale: 1-2-3-4-5-6-7-8-9-10.
